Human Rights Tribunal of Ontario (information)

Information only. This page explains the route; it does not assess whether your situation fits it — for that, get advice from the free legal services named below.

What it can do

  • Hear applications about discrimination in services, including education
  • Order remedies where discrimination is proven (Human Rights Code, s. 45.2)

What it cannot do

  • This site cannot assess whether you have a case — only a lawyer or the HRLSC can
  • Nothing here is legal advice

When to consider it

  • You believe your child faced discrimination based on disability in a service
  • You want to understand the process and the one-year limit
  • You are ready to get legal advice before deciding anything

Typical timeframe

An application must be filed within one year of the incident, or the last in a series (Human Rights Code, s. 34(1)). Exceptions are narrow.

Risks and limits

  • A formal legal proceeding with strict deadlines — get advice first.
  • Free legal help exists: the Human Rights Legal Support Centre (hrlsc.on.ca) and ARCH Disability Law Centre (archdisabilitylaw.ca, 1-866-482-2724).
