What Are Your Rights on the Ontario Autism Program Waitlist?
Direct answer
Ontario invites children and youth into Ontario Autism Program core clinical services in registration order, and an AccessOAP account is required to receive an invitation. While waiting, every registered family can use free foundational family services. Registration order and support while waiting
- Ontario says children and youth are invited into core clinical services in the order that they registered for the Ontario Autism Program. A family must have an AccessOAP account to receive an invitation. AccessOAP helps families manage their program accounts, and an authorized caregiver can use the portal to view a child's service status and funding, book appointments, and communicate with the care coordinator.
- A child who has not received a core clinical services invitation may be eligible for other Ontario Autism Program support streams. Foundational family services are available free of charge to every family registered in the program. Families may access those services at any point based on need, with no limit on the number of registrations.
When the Human Rights Code may apply
- Section 1 of the Ontario Human Rights Code protects equal treatment in services, goods, and facilities without discrimination because of disability and other listed grounds. The Ontario Human Rights Commission says discrimination in services may occur when someone experiences negative treatment or impact because of disability, and disability need only be one factor in the treatment.
- Not every unfair or unequal event is discrimination under the Code. The Human Rights Tribunal of Ontario can decide only applications involving a social area and ground covered by the Code. Sections 34(1) and 34(2) generally require filing within one year of the last incident, subject to the Code's late-filing test. Record the events in detail and how each proposed respondent was responsible, and consider advice from the free Human Rights Legal Support Centre, a legal clinic, a lawyer, or a paralegal.
